As far as the GOP is concerned, they’re been wishing and hoping President Obama has been the outgoing President since about a minute after he was sworn in the first time.

“…might mislead the American people into thinking that this is just about the qualifications of the candidate”

So, the SC canditate may be qualified but, but, “Obama.”

I think that it’s more reasonable for the American people to have a more direct say in that process, which they will do through the election of the president knowing now with certainty that the next president is going to make this really important pick.

It’s part of the job description for the President outlined in the Constitution… nominating people for vacancies in the Supreme Court. That’s usually my first or second criteria I use for choosing who I vote for every four years. The American people do have a say every time we elect a President or Senator. It is the job we expect them to do.

Are the Republicans saying that although the Constitution says that the President’s term is four years, that it is really three?

Or if you are really going to use Republican logic-- W. Bush wasn’t responsible for 9/11 because he had only held office nine months, and in the last year the President can’t make any important appointments, so essentially the Presidency is only two years.

Will Campbell, an awesome southern preacher, farmer, and writer was once asked to debate the death penalty with a well-known scholar. In his book, Soul Among Lions, Campbell tells this story:

The man gave a lengthy and learned statement on why he favored (the death penalty). I had no prepared remarks. So I said, `I think it’s tacky,’ and sat down.

“I think the question before us now is … should the outgoing president
fundamentally change the balance of the court for the next one or two
generations?” Toomey said. “I don’t think that’s reasonable. I think
that it’s more reasonable for the American people to have a more direct
say in that process, which they will do through the election of the
president knowing now with certainty that the next president is going to
make this really important pick.”

Senator Toomey I suggest you read the Constitution since it says how to choose a Supreme Court Justice. And Article 2 Section 2 says it’s up to the President and the Senate to work that out. Suggesting that justices be elected sends exactly the wrong message since our Judiciary is supposed to be Apolitical. Let me be more pointed: We don’t elect Supreme Court Justices. They are appointed by the President and confirmed by the Senate. Mr Toomey if you don’t want to do your job then I suggest that you resign.

He should retire now. His empty seat would be no big deal.

Yes. Since that is100% how this has always worked, until Constitution raping hacks like you got elected.

“I think that it’s more reasonable for the American people to have a more direct say in that process, which they will do through the election of the president knowing now with certainty that the next president is going to make this really important pick.”

We did. Twice. That is exactly what the American people did when we elected President Obama to office for his full 8 years worth of terms in office.

But since you like this “wait until the next election” idea, I say that no GOP Senators can offer bills, vote on bills, offer amendments, vote on amendments, or have any say or vote on SOCTUS nominees until after they stand again for office next time they are up for election.

Deal?

Paddy Power (the Irish betting site that is so accurate that it paid people who bet on PBObama EARLY in the last two elections) shifted HRCs odds from “evens” yesterday to 10/11, today, so they think she is getting more and more likely to win.

And not just presidential elections. Midterms too! Basically the entire federal government should officially suspend its activities every other year.

Well, gee, what a transparent and intelligence-insulting bit of sophistry that is. Presidents can be described as outgoing, basically, from the instant they’re sworn in, and Pat Toomey is a pandering swine, and when he’s outgone himself I will be one happy Pennsylvanian.

ETA I just sent him a scorching e-mail on this cheerful subject.

The electorate should decide? When I voted for the President in 2008 and 2012 , one factor in my vote was the hope that one of the right wingers on the court would need to be replaced and that President Obama would be able to tilt the Court back towards reality.

It’s just occurred to me that if you combine Republican arguments about the functional end of a presidential term with their absolution of George W. Bush from responsibility for 9/11, you’re left with about a two-year presidency.

Damn! Don’t give them any ideas. They’ll try to use that to say that a 2 term Republican President can be elected to a third term because he has actually only served 4 years.

Well given that GOPers blame President Obama for Hurricane Katrina, I think you have to halve that number yet again.
