GOP lobbyist Jack Burkman, who is known for inserting himself in conservative causes célèbres, said in a statement Thursday. “I stand by what I said that night and my inalienable right to be able to say it.”

Missed the part where the judge said anything whatsoever about you, Mr. Ballhog … I mean Burkman. It’s Gates and his lawyers that are under a gag order, which he seems to have violated.

Arrogance, stupidity, misdirection and non sequitur appears to be endemic in the right-wing-nutisphere: The judge is demanding an explanation from Gates WRT her court order and Burkman’s right to speech or anything else is not being questioned; in fact he and his actions are irrelevant.

It is always a good idea to attack judges,not! I can imagine what the judge whom I worked for would have to say. She had no tolerance for a litigant violating an order and rightly so.

I think the purpose of this prosecution is to determine who is “traitor-esque” under our standing legal system …all else is a matter for various factions on the fringe of the matter to beat into the ground.

I’m not so sure that this is bad strategy. I attended part of the Bundy Malheur trial, and the defense had a similar “work the judge” strategy that was quite successful. As long as the players are not people who expect to have to function in the court at lower visibility trials, they can be as outlandish as they want. The implied threat they are making is to have something upon which to base an appeal, which is what the judge worries about. At the Malheur trial, the defense was given a lot of slack and the prosecution less than none. Result was a guy who stole a car on camera in broad daylight did not get convicted, among other things…
