Eight justices will be absolutely perfect right up until the very moment when a Republican president takes office. Then their hair will be on fire over how incredibly overworked the supremes are and they desperately need a ninth.

Done! You think that they’re going to get more reasonable than this guy?”

Hey, look at the big brain on Glenn! If Clinton get elected with a Democratic Senate (and I believe she absolutely will), she’s going to need to plant a sloppy wet kiss on the left. The quickest, easiest way to do it is to appoint a pretty left wing SCOTUS judge and the the Democratic Senate will quickly move them through the nominating process. Any attempts by Republicans to complain about the pace of the process will be met with jeers and laughter. On this issue, they’ve fucked themselves well and good.

… but then again there are votes that would be cast by Republicans so the outcome would be arguable.

It still takes 60 Senate votes to stave off the filibuster of a SCOTUS nominee. I don’t think Democrats will win that many Senate seats this year.

Maybe a majority leader with balls will actually force them to do a real fillibuster?

Of course it’s a mistake. I suspect it’s a moot point though, since the number of people not voting Republican because of Trump is likely to swamp the number of people not voting Republican because their Senator is an obstructionist right-wing asshole.

I take comfort in this. Even with a right wing obstructionism such as Dead Nino-type on SCOTUS, the vote on the Texas abortion clinics would still have been five for the majority opinion, the three ladies plus two fabulous gents…
