God bless you, RBG! It’s so great to hear you say “a few appointments”, because when HRC takes the oath of office, she’ll get to nominate up to 4 justices. Oh, the glory of seeing Madam President shove 4 liberals up the puckered asses of the GOP…well, it’s just about to make me swoon. If Chuck Grassley loses his re-election, I’ll go into a sugar coma. This election may turn out to be the greatest liberal/progressive victory in 100 years, and it’ll be partially due to Donald Drumpf’s clueless campaign and the even more clueless people who voted for him in the primaries. In a twisted way, we might want to send Donnie some flowers and candy for all he’s done for us.

If there isn’t a Democratic majority in the Senate, I would expect to see more blockage by the GOP.

Unless the Dems take the Senate in '16 or '18 McConnell has already said, verbatim, the Senate will not necessarily hold hearings on SCOTUS nominees by the next President if he/she is a Democrat. He would be perfectly fine to let the court dwindle to the mandated minimum of six Justices required to render a decision.

I still think what has to be watched for is the Congress as far as the Supreme Court goes, not who gets elected president.

I would not put it past the Congress to simply pass a bill mandating the size of the Supreme Court to five justices and grandfathering in the rest, thereby making it impossible for Hillary Clinton to nominate ANYBODY.

I have read some commentary that he intimated along those lines. But missed him actually saying that. Do you have a link for it?

As the justices die off, the GOP Senate will simply refuse to confirm ANYBODY until they go under the magic number.

Actually, what the president should do is the SECOND Hillary Clinton becomes president, he should announce that he’s withdrawing the Garland nomination.
