In 2017, he won’t have to. Dems should easily have over 60 seats by then. She is betting on that, though it seems doubtful that any Dem candidates would necessarily pick a very progressive justice. Or even if Obama would for that matter.

She’s right. Whether she leaves the court while Obama’s still president, or someone else does, who can Obama pick who has any chance of getting through the Senate? How likely is it that the GOP, if they take the Senate, would demand that they get to pick the next justice? How likely is it that the GOP, even if they don’t take the Senate, would demand they they get to pick the next justice?
