Silly isnāt she? The SCOTUS ruled on whether Equal Protection applies to folks that want to get married. They ruled a state cannot discriminate on sex ( and sex not sexual orientation is whatās going on hereā¦a gay man can marry a women with Scaliaās graces ) because:
āāno state shall deny to any person within its jurisdiction āthe equal protection of the laws.āāā
from the 14th Amendment. They did not rule on the number of folks that can be in a marriage because that was not before them. So, no, of course this ruling does not allow 3 folks to enter into a polygamous and illegal marriage. No one, not some but not others, is allowed polygamy. No one is receiving protection by the law to enter into a polygamous marriage so there is no equal protection issue. The law says no to everyone.
If someone wants a SCOTUS opinion on their right to marry 2 or more folks they have to get it in front of the Court. They wonāt get cert but lets say they did theyāll get a 9 / 0 ruling to fuck off.
If this is the best line of attack FOX can come up with SCOTUS did a damn good job.

While Iām enjoying the all the heads exploding, this is actually one of the reasons why I think āmarriageā shouldnāt be a State thing at all. I personally donāt have a problem with polygamy, and if that your thing you should be able to go for it. The fear is that people will abuse it for tax breaks que no? The only other clear practical advantage to legal marriage is visitation rights correct? Why do we need to keep the two tied together? Because marriage? Why should a married couple with no kids get tax breaks in the first place? Because living together on a dual income with no children is already a financial break. If you want to give tax breaks to people with families, then give tax breaks for children, not marriage. Then weāre free to make laws about medical visitation and property sharing that go beyond marriage and arenāt restrained by it. Leave marriage to the people who have dear beliefs about it. They can call it whatever they want, and treat it however they want in their personal and or religious private life.
