The guy is a lout and should be run out of office, but I have to agree with the ethics committee that nothing described quite rises to a provable crime. Even in a civil setting I think it would be hard to prove harm over some inappropriate comments and a brief touch. I am not condoning what the guy did but sometimes the law isn’t our best remedy. I have been inappropriately touched (jerks in locker rooms) and the guys who did it were terrible people and on some occasions it did emotionally harm me, however a world that prosecutes such petty infractions becomes a police state quickly, not to mention the problem of proving such a private encounter in a society that values a presumption of innocence. Sometimes people are just awful and for minor problems like this people must settle the issue on their own by social exclusion, public shaming, or other tools societies have used forever and not with the power of law enforcement. Let’s save that tool for crimes that have significant harm and marshal more certain evidence. Public shaming for unacceptable behavior can be powerful, especially when there is a pattern and no apology or reform, and especially to an office holder. Why hasn’t the governor asked for his resignation?
