Any lawyers here? What strikes me is that trump is being sued in his capacity as president, not as a private individual. And it seems plausible that there are things he could have done as a private individual that he can’t do as president. What they’re really trying to do, of course, is to get into an open court instead of arbitration; wonder if it will work as well as it did last time.

Sims says in the suit that he doesn’t recall whether he signed a White House NDA, though, regardless, such NDAs are widely seen as unenforceable.

But Sims did sign an NDA for his work on the Trump campaign. That campaign NDA, he argues, is being used in an unconstitutional attempt to silence his reflections about working in the White House.

I think he’s good to go.

God I love this. Its perfect, sue trump, do it pro bono. Lots of people ought to do this, everyone ought to do this. Hopefully, this is a trend that catches on. Only way to deal with Trump’s threats, etc, is to just sue the grifter.

Attorney Mark Zaid tweeted that his firm was representing Sims pro bono, adding that the suit was an effort “to ensure no Presidential Administration, whether GOP or DEM, can silence former federal employees from discussing unclassified aspects of their public service.”

Yet another American hero.

Yup. IANAL but by the time the challenges wend their way through the courts, the Hamberdlar will (if all goes well) be esconced in his new, improved environment, one where he will learn the insurance value of willingly tossing salads.
