If he were to be appointed special counsel, would he have to give up his appellate court seat?
If not, Rod(less) Rosenstein should appoint him special counsel.

Why would President Donald Trump nominate to lead the FBI the same judge whose nomination to the Supreme Court Senate Republicans effectively filibustered a year ago?

Merrick Garland is a longtime judge. According to his bio he has some prosecutorial experience, and some experience working closely with law enforcement, but not so much experience managing large politicized/bureaucratic organizations. Not so good if you have an organization that needs a whole lot of managing.

Merrick Garland is the chief judge of the United States Court of Appeals for the District of Columbia Circuit who, coincidentally (not) would be the ones hearing any challenges to subpoenas for the WH.

  2. Creates an opening Trump can fill with one of his own compromised appointees.

  3. Puts someone in charge of the FBI Russian probe that Trump can vilify as a liberal with a personal vendetta against him.

  4. And then Trump can fire Garland after disgracing him.

  5. Since Garland, of course, will never be fool enough to take the position, it gives Trump the chance to lie about it, saying “Hey, I tried to put a Democrat in charge but they turned me down!”

He’d have to be a masochist to take it. And stupid, because as a judge he cannot be fired but s head of the FBI he could be fired if Trump was having a bad news day and wanted to change the topic.
