Discussion: Flake: I Won't Hold Up SCOTUS Pick In Order To Force Tariff Vote

Come on! He may not be a Trumplican, but he is still a Republican. Stacking the SCOTUS with activist judges is how a Republican minority cement their control on the nation. And he wobbled about for maybe 15 minutes before he voted for the $2 Trillion tax give away to wealthiest Americans.

Forget Flake. This a golden opportunity for Dems to expose Trump mercilessly.

Democrats can use the inevitable pre-election Supreme Court appointment to expose Russia collusion. Do this right and McConnell will regret ever having these appointment hearings before the next election.

Give Trumpā€™s picks the same treatment Jim Jordan is giving Rosenstien.

Ask Trumpā€™s picks if they believe intelligence assessments that Russia meddled. Then ask them if they believe the same assessments that say they did it to HELP TRUMP and hurt Hillary.

Anyone they try to pick will have to state beforehand if they believe Russia meddled. And a lot of other inconvenient truths only a Trump appointee might suffer for.

They will also have to answer the question "If evidence proves that Donald J. Trump personally colluded with Russia or advised anyone in his campaign to do so, would they protect him from prosecution?

Each of them will be asked ā€œDo you believe a President is above the law?ā€

Each of them will be asked if they have been coached on that very issue in any way.

Each of them will be asked if they believe the evidence that the FBI and CIA offers or do they doubt our intelligence agencies.

Hopefully, if McConnell rushes through this, Democrats will have some serious campaign video clips of them challenging Trumpā€™s pick on points that really matter to their own base. Consider their conundrumā€¦ if they agree that Russia meddled with our 2016 election, they telegraph to Trump they arenā€™t his puppets, but if they fudge their answer to assuage the Fat Orange Pretenderā€™s ego, they will expose their rank hypocrisy.

Democrats can turn these hearings into a referendum on judicial integrity itself, and that canā€™t help Trump in any way, and can only imagine how easily these judicial picks can be challenged because ot Trumpā€™s outrageous nature.

Ask every one of them if they believe it would be a crime if Trump ever personally encouraged Russia to commit a federal felony to support his election. Then when they obfuscate just play the video of his speech where he did just that and ask them again if they consider that exactly what they just denied.

These are lawyers and former prosecutors who will be asking these questions, they know better than I do how top pose a question in the manner I propose.

Democrats can turn this pile of crap into election gold.

Hopefully, McConnell wonā€™t figure this out before the election. Iā€™d wager he already fears what that will result in, and heā€™s stuck himself between that impending loss of the House and his personal desperation to add another anti-progress judge to his legacy of lifelong hypocrisy.

If they give Democrats this stage to perform on before the election, it will just add more seats to their House majority, and may even win the Senate.

It is that close, this could push it all over the edge, if Democrats are willing to pull a Jim Jordan on every trump nomineeā€¦

I hope all TPMers read Joshā€™s column this morning. A Trump picked 5th Justice could very well be the one that creates a court that lets him off of the Mueller investigation and who knows what.
Donā€™t say it wonā€™t happen.
My daughter, a 20-yr seasoned defense atty has been saying for some time that this could happen, not that it will happen, but is within the realm of possibility

and there IS a way to fix the Supreme Court imbalance whether people accept it or not.

An amendment to the Constitution that requires judges to face public approval (50% or better to remain) in a ballot. Do the off-year before every Presidential election, allow them to remain when they lose just until the next President finds a replacement.

It doesnā€™t give the people the right to elect judges, it gives them the right to eject them, though.

And for all the hand-wringing ā€œoriginalistsā€ out there imagining themselves purists protecting the Constitution, if the founders considered their version of the Constitution so perfect, why did they allow for amendments in the first place?

Get serious.

I think even THOSE judges will be appalled at what Mueller knows, but I share your concerns anyway.

ā€¦just do it ONCE, they did it for Bush in 2000, simply write the amendment as a one-time event, I should have clarified that. A big enough majority in the House and Senate could accomplish that, call it ā€œThe Trump Judicial Housecleaning Amendmentā€ or something that explains why it happened.

Iā€™m all down for handwringing. But the more pressing question to me lately is whatā€™s the game plan for fixing this mess?

My bullet points would be

  • Impeach Trump
  • As fruit of the poison tree, impeach both his SC picks
  • Undo his Muslim ban, etc, as more fruit in a deplorable basket
  • Fix gerrymandering

So thatā€™s just off the top of my head. Now that Iā€™ve done the hard work of sitting here posting on a website, whoā€™s going to do the easy part and implement that? O, and how?

Perhaps Flake forgot why he decided to retire, because if heā€™s sincere THIS fight would be where to lay down the gauntlet.
