Kudos to the defense attorneys who found this. Stealing is bad but the contrarian in me appreciates legislators looking foolish, no matter how retroactively.

Thanks for reporting this case. I am afraid the kind of legislative screw-up found here is not uncommon but such screw-ups are not often reported in the press. Things have only gotten worse as legislatures have reduced costs by retiring or laying off long time legislative aides who assisted in the drafting of legislation. Those long time aides were often highly qualified professionals. In many cases they have been replaced by ALEC and other special interest group legislation drafted by highly partisan, but often newly minted attorneys. In the area of criminal law legislators have been left to draft laws themselves. That is a task way beyond most of them. .
