Everyone on the Internet who accused me of “scaremongering” and “blackmail” when I told them refusing to vote for Hillary in the general would affect the country for a generation or more because of judicial appointments please go fuck yourselves.
The ability to appoint judges does have consequences. When Republicans have that ability, no good ever comes of it.
So, denying state funding for any clinic or doctor who prescribes viagra or cialis, or maybe a place that provides breast cancer treatment, would be fine, too, since those places have no constitutional right to prescribe or provide that treatment either. Might as well cut off funding for those hair transplant places while we’re at it.
It would seem that an equal protection argument was missing in this case if they just relied on due process and free speech - not that it would have made a difference to the Republican majority.
Those of us in the law refer to cases like this as “result-oriented jurisprudence.” Which is lawyer speak for figuring out which side you want to win, then twisting the reasoning to get there.
(Some years ago, I sat across from Judge Sutton–who wrote the majority opinion–at a dinner. We did not talk about abortion. He seemed like a pleasant, intelligent, dispassionate man with a sense of humor, and less than the common amount of judicial arrogance. On the other hand, he was also the author of the Sixth Circuit case that the Supreme Court overturned in the gay marriage case, Obergefell v. Hopkins.)

First, that’s like saying I have no due process right to sell something I own or provide a professional service of any kind, which is entirely bullshit. Second, this opinion was written by the Federalist Society, as was the legislation and the lawsuit defending it.

That was what made my blood run cold that dark night in November 2016. I knew as soon as Trump stole the presidency that we had lost the Supreme Court and the bulk of the federal courts for at least a generation no matter what ultimately becomes of Trump. This damage will be difficult if not impossible to undo.
Back in 2016, Jimmy Dore said that making a big deal about court appointments by Clinton or Trump is fear mongering and the equivalent of the moon falling into Lake Michigan. It looks like the tsunami from Lake Michigan is washing over Ohio.
Absent impeaching and removing Trump’s judicial picks they are in their jobs for decades. The only possible remedy is to expand the number of judges, including Supreme Court justices, to offset the massive number of young right wing extremists now on our courts.
Wørd. It was 2015 or early 2016 I was told I was “fearmongering”.
Post election this same person was freaking out about Trump’s “win”.
Same thing happened last Summer / Fall - I was arguing for #UnityVoting in November (and in in all future elections until we’ve cleaned up the country, so a generation) and a core group of “I will vote for Who. I. Want.!” types were awfully upset that I was pointing out the consequence of that is electing Republicans.
But the Sunday after Kavanaugh was sworn in one of them was, again without any self-awareness of the change in position, arguing for #UnityVoting.
Go figure.
I’ve felt for years that with some exceptions roundworms have more intelligence than most humans. The data keeps accumulating that I might be right.
Didn’t Kavanaugh say basically the same thing in his dissent? “It’s not attempted murder unless my bullets actually kill you.”
Can we now go after religious affiliated charities and hospitals that promote religion on the government’s dime which is clearly unconstitutional?
Unfortunately, clinics that furnish Viagra or Cialis don’t need state funds. They get plenty from their pigeons, err, patients.
I’ll believe Republicans are sincere about their anti-choice (and really, can’t we re-brand that shit anyway? Nobody’s pro-abortion. They’re anti-Choice) stance the day that they support:
-Universal childcare for working parents
-Welfare for single parents
etc. etc.
This business about only supporting the thing until it pops out into daylight is anathema to all of the religious ideals they claim to support…
If past is prologue we show expect to see an increase in HIV infection rates in counties with high needle usage rates among drug users.
It’s already impracticable for tens of millions of red-state Americans. When you only have a few clinics per state, the right to abortion is very substantially restricted. I’ve spoken to a couple of ACLU lawyers who think that it’s a lost battle and resources should be focused elsewhere, particularly as it’s the #1 GOTV issue for the Republican base.
