Somebody needs to tell this judge that this is basically the same thing that Medicare Part D has been doing for many years now. So it’s now not allowed … because it’s President Obama’s baby? Tell that to ANYONE on Medicare, please – you will have the AARP so far down your throat in a heartbeat you’ll believe you’re giving deep throat to a horse.

Good point. I think the Circuit will shut this down and if so, and if the Supreme Court even bothers to hear it, they might get a 5-4 vote supporting the circuit. One thing I do know about Roberts is he’s not a big fan of the other branches of government using the courts to do what they lack the political power to do themselves.

To the lawyers among us, particularly those with experience before the federal bench, does that have any ramifications on how quickly or slowly the case can be appealed, or is it just a meaningless coincidence that will have no effect on further proceedings?

Actually, this could be a 5-3 or 6-2 vote in favor of the President. Kennedy and Roberts may not like Obamacare, but they’ve shown little inclination to do any further damage to it since making Medicaid expansion optional.

The Federalist Society strikes again. Time after time you see one judge go contrarian and after a while, the adults step in and right things.
But their long term goals of clogging the judiciary with disruptive justices like Collyer could well fall prey to the forces that threaten their hopes for total bans on abortions, prayer in schools and other goodies. The rising tide of conservative judges may have crested with the passing of Scalia. Let us pray that November brings to bear the forces that turn the tide in the right direction.

I don’t know of any effect it will have on the proceedings. It may have made her feel more able to issue rulings that are controversial (I need to read it), but it won’t have any effect on the appeal process.
