I think that is what he is saying. In a democracy, you need to sway public opinion. Sentiment against Capital punishment is already slowly increasing, If you had firing squad’s or guillotine’s that would move it even faster.

And I think it actually is less barbaric (still barbaric) than the last few lethal injection execution. A few high caliber bullets would cause almost instant death.

How about we ban all executions? Capital punishment is barbaric and cruel, and it needs to end.

Having capital punishment is certainly no deterrent to crimes involving murder. Also, just remember the people who were executed who were innocent.

At least some more enlightened states have gotten rid of the practice. Not optimistic about some of the others. Despite recent botched executions, Arizona seems to have not learned a thing. It’s making excuses and digging in deeper. Ugh.

Of course they are better methods, but we use “lethal injection” to make sure witnesses never see blood. Society just wants the condemned to go to sleep quietly so we don’t have to take responsibility for what we are really doing.

I’ve always liked public square hangings. And making the whole [extended] family of the executed watch. of course these days everyone is just too busy so we’d have to televise it on FOX every evening.

I can already envision the interviews and “commentary”.

Alabama said to be considering Breaking Upon the Wheel as well.

The government started using lethal injection because it was deemed a more humane way to carry out the sentence of death. Lethal injection has been in use for decades, and until recently the procedure went as intended. I could be mistaken but I believe in the past year or so there was a change in the mix and type of drugs used in the procedure, I’m guessing that’s where the problem lies.

I understand having the miscreants drawn and quartered was very popular in the Dark Ages. Might make for some exciting coverage - CNN and FOX, I’m looking at you!

I really don’t understand this dissent. It almost sounds like he is saying that all death penalties are cruel and unusual and so by definition can never be humane. Knowing Judge Kozinski’s ordinary approach to other matters, I bet he disagrees with what I just wrote, but if so, I really do not understand what advice he was giving to the states, which must live within the boundaries of the 8th amendment.

A number of wealthy people were executed prior to Furman v. Georgia. Since executions resumed in the 80s, I can’t think of any.
