She should be able to depose Trump and Cohen on that subject. Avenatti may also think that he can prove the agreement is illegal and unenforceable as a campaign finance violation, so that she may even be able to keep the $130,000. The most significant development here is that Cohen’s attorney is dropping his demand for arbitration, meaning this case will be decided in federal court after depositions and discovery.

Cohen and tRump could have saved themselves a lot of headache by making this offer a long time ago when Avenatti first offered for them to drop it. Now that Team Stormy wants blood via depositions, they finally want to back off. IMO, Stormy should pursue her case to reveal all of the lies, cover ups, and threats so Tramp’s other victims may be able to reveal their stories as well.

I think it’s safe to say the demand for the 130K back is just cover for their real purpose: keeping Trump from having to fess up. Whether she pays back the money or not this ends her pursuit of Trump. She’s already told her story so there’s no game there. Smart folks will see this for what it is. The name “Essential Consultants” sounds like they sell perfume, which may be the case since they are trying to cover up their clients’ stink.

I don’t think so. This crap goes to a Judge at some point. He or she is likely to dismiss all of it as the only substantive argument was the NDA breech which is now moot. I don’t see Trump having to face a deposition for the weak case Daniels has against him. My guess is it’s over. We all know the truth anyway and that was Danials’s point.
Everyone around Trump realizes that it is important to keep Trump from testifying or being deposed under oath under any circumstances.
Whether it’s Mueller or one of his myriad civil cases, any Trump testimony is a perjury trap. The man will not be able to stop himself from committing perjury. His only defense is that he actually believes the lies that he tells. If this is not then perjury, it meets the legal definition of insanity: inability to distinguish between fantasy and reality.

Ms. Clifford is a very smart woman, she will be fine. I wouldn’t at all be surprised to find that there is a lot more to Ms. Clifford’s resume than what she is credited with.
