All this will do is create jobs in the asthma and moving industries, because more kids will develop asthma and folks living on the coasts will have to move as the water takes out their communities.

While it’s tough to decide which are the most dangerous outcomes of a Trump administration, this has to be near the top of the list. The time we lose in dealing with global warming before a Democratic (or at least a more reasonable) majority takes over will be deadly.

The CO2 rules were the result of a rule-making process under the Administrative Procedures Act. Rules implemented under an APA rule making proceeding cannot simply be swept aside by executive order. It takes another rule making proceeding, based upon a rational interpretation of the relevant statute, rational as in “this is a rational way to execute the statutory mandate of Congress.” That process occurred as the result of a U.S. Supreme Court ruling that ruled CO2 was, in fact, as “pollutant” under the plain language of the Clean Air Act and the EPA was therefore required to regulate point-source emissions to abate the pollution.
But the Make America Great Dictator thinks he can rule by decree, creating, executing and interpreting the law. And now we get to pay a needless bill for Justice to try to defend the indefensible in yet another protracted piece of litigation, one where government is likely to be taxes with the other side’s attorney fees.
I for one won’t cry when the flood waters reach Mar-a-Diablo.
Ideologues cannot govern because they can never work with reality but are always working against it. Right now we are in the grips of the Republican Hegemony and people are going to get to observe this first hand - let’s hope the experiment does not continue clear to the end of our country as we know it.
It is not just the loss of our nation’s efforts but the loss of our nation’s partnership and leadership with the other industrialized nations of the world. When do we start rebuilding the buggy whip factories? Can I tear down my solar panels and start burning coal in my backyard now?
Pretty sure the courts will block this. You can’t change the Federal Register by fiat. You have to go through the promulgation process.
What can happen (and has in the past happened) is that the agency head my de-staff enforcement. But we’re talking here about major capex and I expect few utilities will want the overhang of violating an existing regulation…even if it’s currently not enforced.
