There is no legal reason why they should not be deposed, especially since they are guilty as hell based on the documents that have come out. This is why the Republicans are pushing so hard to install Kavanaugh, so they have a reliable Court that will let them get away with their shenanigans, that will create law out of thin air to support doing what they want. That likely won’t happen for this case, since Kavanaugh shouldn’t be in place before they decide this…unless the Republicans on the court (yes, I said it) drag the process out until they have their fifth vote.

Ginsburg should reject it out of hand based on the merits, and she could, but she is also a fair jurist and will do the right thing. That really is how it should be, it’s far better to do things right and then get rid of the cheaters than become them.

The actual legal issue before the Court is if there is imminent harm PLUS basically certain error. Given that Ross can simply take 4 hours from his daily nap to sit for a depostion there is no harm, and the Order is well founded in law.

The reality is that there is no way, no how, that a stay should ever be granted. Any justice who would get involved in this is acting in a nakedly partisan way. Lets just make that clear.

This appears to be an invocation of the Trump privilege: I don’t have to if I don’t want to.
No way a depo is not appropriate. And because a depo would place them in jeopardy of perjury - or of telling the truth, they definitely don’t want to be deposed:

In a depo, Gore (and Ross after him) would be questioned under oath about relevant matters.

So, as Trump would say, it’s a “perjury trap.”

Similar applications at lower court levels for blocking the depositions and the discovery have been unsuccessful.

One can only hope that will continue. If Kavanaugh is seated, it’s game over, man.

I recognized the name of the US District Court judge in NY. Under more normal circumstances I would never know the name of him or any other judge in a federal court that is 3000 miles away from me.
