Rules and process clearly don’t matter to the Trump administration or the Solicitor General. We’ll see if they still matter to the Supreme Court.

John Roberts and the majority of conservative justices on the Court see the Court as a political instrument and as a conjoined appendage of the christian conservative movement and Republican Party. The newest christian conservative Rapist-Boofer justice’s rant against the Senate Judiciary Committee confirms that view. Remember sleazy Alito when President Obama was speaking at the State of the Union?

My money is on the likelihood that the Court will be very deferential and bend over akimbo. On national security grounds, of course.

I am very curious to see what the christian conservative Rapist-Boofer justice has to say.

Solicitor General Noel Fransisco filed an unusual letter with the Supreme Court Monday suggesting that the Supreme Court “reconsider” delaying the case’s post-trial proceedings.

The letter continued, “If you know what’s good for you!”

Trump wants to get rid of any “lower court” looking at his Admin. Wonder if this is part of the Flood and/or Judicial Watch plot ro remake rhe judicary. Recall Whit-less-taker’s disdain for Marbury vs Madison.

They have good reason to believe that. They have four absolutely guaranteed votes and another one if they apply a little bit of pressure or enticements.

The court already said no once to a delay. I think, hope, that the Supremes don’t want to look as though they are jumping through Administration hoops because of partisanship.
This is most likely true on the conservative side for Roberts, who has already taken an unusual step in responding to T’s claims that there are Obama judges and Bush judges. The unspoken premise of that claim is that Trump’s appointees on SCOTUS are Trump judges - and will vote in lockstep with his wishes.
I really doubt that Roberts wants to go down in history as the CJ that allowed the court to become and be seen as a lap dog to the Executive. Sort of the anti- Chief Justice Marshall. I don’t think that all the other justices from the Federalist Society’s farm system are quite as tuned in to institutional concerns. OTH, we are talking about people with some pretty big egos. I don’t think they want to be seen that overtly as Trump’s tools.

Let’s see…we have Trump attacking CJ Roberts, and now the DOJ is trying to bully the SC en banc. (I know that’s not how that term is used, but it seemed appropriate for this situation.)
You have to wonder if their party allegiance is stronger than their identity as an equal branch of government.

I am not so sanguine that Johnny Roberts’ legacy and stock will rise very much higher than conservative Chief Justice Roger Taney of Dred Scott infamy. After all, Johnny declared racism over, money free speech and bribery of conservative christian governors with suitcases of money, Rolexes, vacations and luxury cars constitutional. Johnny Roberts personally went out of the way on behalf of the christian conservative extremist movement to bat for Governor Forced Vaginal Ultrasound and to keep him out of jail. And the Muslim ban? That was national security, of course. Duh.
Johnny’s comments over the Thanksgiving weekend was smoke and mirrors feint and deception.

Perfectly reasonable - I’m more hopeful then anything. He has given some indication of his position as leader of the branch, and his response on the characterization of judges by appointing Presidents suggests to me that he has the notion of an unbiased court tucked in there somewhere. His description of judges as umpires at his hearing was simplistic at best - sort of like Scalia’s belief that we can discern the Platonic intentions of the founding fathers as to gun control.
The base line for me is that Toberts isn’t blindly saying yes to everything Trump wants. And the more Trump suggests they should and do heel when he whistles, the more turned off roberts will be. And that means maybe he won’t go with gut reactions but get more into issues.
I don’t think I’m totally naive. I’ve seen it happen.

The degree of frantic desperation the administration is showing in this case is difficult to square with the subject matter. I’m inclined to think that they’re trying to cover up something much, much worse than what we already know about. Like maybe dead 12-year-old boy sex slaves.

The GOP is very anxious to delay this proceeding until it is too late for the 2020 census. That tells me they are convinced the question will have a real impact on results in the Southwest.

Um, I’m not sure about “results in the Southwest” but, yes, a badly skewed census will help entrench the GOP in various ways. I don’t think there’s any doubt at all that adding the question will reduce the number of people responding to the census and those people are somewhat more likely to be Dem votes and significantly more likely to be urban dwellers. So, resources (including political resources) allocated based on census data will be misallocated in ways that benefit the GOP and hurt the Dems.

There’s no doubt at all that the reasoning for adding the question is: It benefits the GOP. We can argue about how much it benefits the GOP but there’s strong evidence that the value of the question to the GOP far outweighs whatever negative political price they might pay for it. Sure, some legal and/or think tank resources will be spent on the issue, protecting people from legal consequences and spinning misinformation to soften the political fallout but I can’t see the GOP losing very much at all politically. Assuming the issue is decided in one way or the other by the SC, I can’t see Roberts and Co. worrying much about the political fallout. Maybe they try to soften it a little bit by adding a few ifs ands or buts but I think they’ll make sure the question is added to the census, given the opportunity.

So, yes, delay is the only way for the Dems to win this one. I think it’s possible they’ll be able to delay things so that it’s impossible to add the citizenship questions but even with a serious delay, I’d guess the GOP will figure out a way to add the question, even if it’s a costly complicated change at the last minute. The Dems should at least try to extract some political price and maybe, just maybe, they’ll get lucky and some Republican involved who doesn’t benefit from the big picture effects of adding the question will back down but at this point, I don’t have much hope that the census will happen without a citizenship question.
