The only way the supremes take up this case is if they can claim they’re not setting a precedent. Because this would get cited every time an AG decides not to defend a particular case and a republican wants to pursue the defense anyway.

Another case where Republicans want to jump up to the SC in the hopes that the right wing five rubber-stamp their wishes. It’s getting ludicrous how much they are jumping over the regular judicial process to put something in front of the SC, and it will be disturbing if the SC starts accepting all these cases and making snap judgements on them. That’s why the Republicans have worked so hard to give us a right wing SC, so they can have judicial review on everything they want done essentially by fiat…if Roberts starts going along with their plans we’re going to have a lot more problems in the nation.
