First off, WTF is the DoJ doing defending Trump when It should be a matter for his private lawyers? And even if this were true, the emoluments clause was, as far as we know, observed by all the other 43 intervening presidents.

I grew up on land that George Washington once owned. 3 miles from Mt. Vernon. I learned to fish on Dogue Creek about 100 yards from that grist mill. I went to school with descendants of George Washington’s slaves he freed upon his death. Benedict Donald is no George Washington.

Seriously, the Founders were not always scrupulous in carrying out their principles (like us) or even the laws that they made (like us). That Washington may–and I emphasize MAY–arguably (and I don’t think it’s much of an argument) trod on the Emoluments Clause does not justify what he did–if he did it–and certainly does not justify the present pretender in using the federal government to line his bottomless pockets.

That was my first thought. This is his private business with the sham that he’s donating all the proceeds to the federal government, which is exactly in part what is being contested here as I understand it.

I had the same question in another thread. It’s because the challenge is on constitutional grounds — in those cases, it’s the Justice Department who defend the office. A procedural thing, but there it is.

That said, The Justice Department should be pretty ashamed and embarrassed that the Mt Vernon tourist website is their “evidence”. That one doesn’t even pass the laugh test

Trump is asking the Fourth Circuit Court of Appeals to stop discovery in the case from proceeding.

I would guess he is even more afraid of what discovery would turn up than of the emolument case itself.

THE DOJ is doing PRESIDEnt trumP a disservice. THEY DIDN’t even MENTIOn in their brief this FROM THE WIKI:

“academic Seth Barrett Tillman said that the restriction (meaning emolument) does not apply to the president.”

I love the comparison to the purchase of federal lands. If the purchase was made for the real market value, no problem. More importantly, those founding fathers didn’t turn the purchased property into venues where foreign governments could prominently spend lots of money. Talk about grasping at non-existent straws. Sorta makes you think he clearly violated the clause and his lawyers know it.
