Has the Commerce Dept. stated openly on why the question wouldn’t negatively impact Congressional districts that have immigrant populations? If they factor out those without US citizenship status then they should also factor out those with US citizenship status that don’t physically reside in the district, military service members that are stationed overseas or outside their district that they vote in.

Yep. Skipping the 9th Circuit by going directly to SCOTUS is already a bad faith effort, especially when you don’t have the facts on your side to fight this case through the regular appeals court process. Anyone thinking this Solicitor General at DoJ would stand up for the process, argue the case on the merits and follow a normal appeal, have sadly miscalculated.

I wonder how Roberts feels about the administration seeing the Supreme Court as a rubber stamp: avoid the usual process and go straight to the Supremes, because they’re friendly. I hope Roberts’s interest in the historical role and prerogatives of the court will make him really cautious.
If Trump gets another appointment, the court likely will be completely undermined in performing its independent role.

The Trump GOP desperately want to undercount the census, so appealing their mechanism to the Supreme Court makes sense. They need an answer ASAP. If the actual number of persons were accurately counted, it would mean more — gasp — urban centered congressional districts. They can’t abide by that.

SC will say question can stay, but allocation of House seats must be for all peoples including non citizens.

(Thus keeping states like Texas with plenty of seats)

This may seem to be a win…

But the SC will allow states to allocate state districts to citizens only (states rights!)

This will allow states like Texas to limit powers at the state level keeping state legislative districts Gerrymandered to help rural areas which then means those are who will write the new districts.

I fully expect the originalists on the court will declare not only that noncitizens may not be counted, but that African-Americans can only be counted under the 3/5ths clause.

Democrats have to put maximum pressure on the Court, which is already the subject of extraordinary political pressure from the GOP. It’s naive to think that this has no influence. If I were Schumer, I’d be saying things like “The legitimacy of the Supreme Court as a nonpartisan body is at stake in this appeal.” Because it is.

And the text of the decision can be very simple: “Because go fuck yourselves, that’s why”

It’s not at stake. We’re well beyond that point. It’s a wing of the Republican Party. Should put up elephant statues outside by the steps.
