Discussion: DiGenova Still Chats With Trump Despite Not Joining His Outside Legal Team

Umm…If DiGenova and Toensing are conflicted out of representing the Orange Menace, then it is unethical for them to consult (chat) with him about the matters that they would have represented him for, but for the conflict. Now, if they are chatting with him about the NCAA Final Four, or real estate matters involving Mar A Lago, that’s a different matter. But the scandal that tRump is involved with should be off limits completely. Indeed, they shouldn’t come within a mile of it.

That’s OK Joe…we have no respect for YOU. You cowtowed, sucked, crawled and otherwise debased yourself to get into Trump’s ā€˜favor’ only to be kicked in the teeth for being ā€˜slovenly’. And now you want to assure us that you ā€˜are still talking’ to the man that did this to you. Wow.

Well, it’s kind of newsy if he’s Trump-whispering about how pernicious and illegitimate the Mueller investigation is. Sorta potentially consequential.

I’m assuming that lawyer/client confidentiality only applies when there is a lawyer/client relationship. Right?

Yes. As an attorney, I’d say this is dangerous for DiGenova. First, Trump has few loyalties except to Trump. So unless these two have some relationship going back decades, I’d say Trump would throw him under the bus on any chance he got.

But more importantly, Trump is a moron. Even if he liked you and was trying to be loyal to you, he’s an idiot. As soon as he said, ā€œwell I was told that this would be a good idea by Mr. DiGenovaā€ - Now you’re in serious hot water because he can’t give Trump legal advice. Sure DiGenova would deny it, but why would he take such a stupid risk?

And a corollary to that point is that any and all such conversations are, by definition, not subject to the attorney-client privilege (i.e., DiGenova and Toensing could be deposed under oath and required to discuss them). Unless Trump is taping everything (which I believe was debunked in the Comey affair), this is not really a problem for someone who is willing to lie. In other words, D & T could say they were just talking to Trump about the weather. But maybe they’re not willing to lie under oath. Whether it’s from pure honesty or just fear induced by the mounting number of convictions of people who have lied to Mueller’s investigators, Trump’s chats with Joe & Vicky would seem to have the potential to create some additional evidence as to DT’s state of mind during this time-frame.

How is that not a conflict? I mean, if they’re talking baseball it’s not but you know there’s legal advice in between calling pitches.
