“The enforcement of the emoluments clause is the only way we can preserve our ability to do our job,” Blumenthal said. “If Congress does not have standing, no one does.”
Feature, not a bug.
DOJ argument that it’s other Congress critters at fault is, um…novel.
Only those with the trademark of the Trump are allowed to trade with us.
Here’s hoping this suit is allowed to proceed.
The Justice Department, which has filed for dismissal of the case, declined to comment. Its lawyers argued in court papers that the 198 Democrats suing the president are not being injured by him at all but by their colleagues in Congress, who have refused to take up the emoluments issue.
A little twisted, but still funny.
“… by showing they’ve suffered harm from the alleged violation of the clause.”
This seems to be a pretty weak leg to stand on. If a president has violated TOS, the clear remedy is impeachment.
That’s not going anywhere either, but at least it would be a straight shot.
The DOJ argument actually makes sense: Stand up, Congress.
We knew without knowing just how that he would use the presidency as a piggy bank. Or a bank for himself, the biggest piggy of them all.
