I’d like to see the Dems in general do more of this. The R’s have done this for years weaponizing the courts using them to oppose everything.

That said, while the filing probably has merit, the courts in general have traditionally not gotten involved in these kinds of fights that there is a political process possible (howeiver unlikely) the courts have deferred to the political process.

Like I said…would love the Dems to sue them all 100x a day for every thing they say and do. I just don’t think this one is going anywhere.

I hear ya, but just think how much MORE water has gone under the bridge this last 7-10 days. Won’t that help make the case here? At least in front of a non-batshit crazy judge, anyway.

Hey, I’m all for it. But not doing it then, when that actually was a huge issue, was a missed opportunity and it looks weaker than it could be. And no, I don’t think his being a scumbag will affect a normal judge looking at this particular case.

About time Democrats get some balls. This needed to be done aganist McConnel when he delayed Merrick Garland. I hope this is the beginning of more. When you are up against the likes of today’s Republicans, you need to fight fire with fire.

I am not a lawyer, but my understanding is that this is likely to be dismissed with “If you don’t have enough data to advise and consent, do not consent.”

This is primarily an internal Senate issue, where one part of the Senate is acting in severe bad faith to keep the minority from having a say in an irrevocable (essentially) decision. I don’t know that any attempt to intervene on the part of the Judicial branch would withstand Constitutional scrutiny.

That said, wouldn’t be the first time I’ve been wrong, and Sen Merkley is more qualified than I am (but also more likely to be showboating here). And, even if this is all just a publicity show with no hope of the courts hopping in to help, there is definitely something to be said for making some noise instead of rolling over and taking it, again.

Sen. Merkley was the person who blew the separating families at the border thing wide open.

I like it that he’s more action less talk.

I think that part of this is setting up the record for what happens after kavanaugh is confirmed. If, say, he was involved in the decision to stonewall.
