Discussion: Criminal Charges Against Kavanaugh Unlikely, Even With FBI Probe

Rape is about power. Prep school boys are expected in the course of their education to understand the dual-edged aspect of assuming the trappings of power and its proper exercise. Brett seems to have had trouble with power his entire life, using his attorney power to harass and harm rather than resolve conflict and defuse urges for revenge. Whether you treat the situation he now denies as attempted rape or completed battery, it is clear that he overpowered a 15-year-old girl without consent. And now the bulk of GOP members of the judiciary committee want to give him more power?

Also, criminal charges are unlikely because perjury in Congressional testimony has become a rarely prosecuted crime.

The decision as to whether or not to prosecute someone for lying to Congress is mostly a political decision because, you know, that is America’s equal justice under law.

Raise your hand if you think he’ll be impeached from his current lifetime appointed federal judgeship.

If the FBI were to investigate everyone would state they don’t remember. So why bother?

If Tom Steyer, the Simon sisters in Indiana and other ‘angel’ backers of the Democrats want to help, invest some of those millions in hiring 100 investigators to dig to the bottom of this ASAP!

As a practical matter, MD isn’t going to pursue this. They’d never get a conviction unless someone happened to be shooting 8mm home movies of the event.

But when it comes to the statute of limitation, boys and girls, it doesn’t matter what the current law is. What matters is what the statute of limitations was in 1982. A State can’t change the statute of limitations, then use it to prosecute someone who would otherwise have been untouchable because of the statute. That would be an ex post facto law, and would be unconstitutional.
