Even worse is how Mulvaney is wanting to be acting director for an agency he deems ā€œa jokeā€.
AND on top of that, we’ll have a trump appointee making the deciding decision on this.

Perhaps next time someone thinks ā€œboth sides are the sameā€ will stop and remember the shitty antics of this administration and the type of people involved in this fucking clown show.

Judge Timothy Kelly, a Trump appointee approved recently by the Senate, will hear arguments on the case late Monday afternoon.

Gee, I wonder how he’s going to rule on this…

That’s actually a great question. Mainly because he was confirmed on a 94-2 vote, which I took as a probable sign of his judicial competence.

The facts are not all that messy…how they’re being presented makes them appear so. Tribe took a look at the DFPB Attory’s reasoning and found it weak and unsupported. Former Mass. Rep. Frank laid it out clear: the law was written to keep partisan politics out of the CFPB and the language in that law specifically lays out who takes over in the resignation of the Director. The Director picks his or her successor unless incapacitated and that pick finishes the 5 year term of the person being replaced. That’s what the law says. So now we get to see if the GOP’ers know what ā€˜The Rule of Law’ means or are dedicated to it. In this case there is a law and it should rule the situation. Trump is a man but trying to rule it as well. Lets see their stuff.

Trump will rage and tweet and stamp his feet, but he can’t fire a federal judge.It’s a lifetime appointment, he doesn’t need anything from Trump. So there’s that.

Article II, Section 3 of the Constitution requires the President to ā€œtake Care that the Laws be faithfully executed.ā€ This clause, known as the Take Care Clause, requires the President to enforce all constitutionally valid Acts of Congress, regardless of his own Administration’s view of their wisdom or policy.

Absent a change in any of those laws, shouldn’t the appointment of officials who are on record as opposing the enforcement of said laws, such as the Consumer Protection Act or the EPA, be considered a violation of the Constitution—and therefore an impeachable offense?

I’m really taking issue with this. It’s the second or third time now that TPM has reduced his quote to simply saying he called it ā€œa jokeā€. But the full quote is important because what he really said is much more potent.

In fact, he called the CFPB ā€œa sad, sick joke.ā€ That distinction is important. Simply saying it’s ā€œa jokeā€ is disparaging, but not threatening. Calling it ā€˜a sad, sick joke’, speaks of raw contempt and intent with regards to that agency. It is definitely threatening the agency to put him in charge of it. Fox, meet henhouse.

Why does Trump keep appointing people to lead agencies they despise and/or would love to dismantle altogether? What if they’re successful, and cause those agencies to fail? What then? This has to stop.

I totally agree. For that matter, given that the ACA is ā€œthe law of the landā€, Trump’s attempts to sabotage it flies in direct contravention of his oath of office and the mandates of his office. To take care that the laws be faithfully executed. There’s no wiggle room there, or room for personal opinion. He has a Congress to work with to change rules or laws he doesn’t like. Otherwise, he’d better uphold them faithfully, or be taken fully to task for not doing so.

I’m almost ready to accuse this president of sedition, and conspiracy to harm our country and its government. No joke.
