You can’t legally enter into a illegal contract. You work for the people of the United States first, Trump second. This agreement would never hold up in court.

So they are rolling out two talking points to try to control the narrative. (1) Omarosa violated a phony NDA, (2) Omarosa violated national security by recording in the Situation Room.

I think #2 is where all the cool kids in the Beltway Press will go.

I would love to have seen the Fox News meltdown if Obama had even hinted at NDAs for white house staffers. “Fealty to King Obama is demanded!”

Really? In about 55 years observing US politics, this is the first I’ve ever heard of such bullshit.

Let me suggest, Kellyann, that the public nature of the “employment” (public service) conducted in the WH means that such restrictions are void as against public policy, unless we are dealing with properly classified national security material.

Yup - 1st organized crime family to take the White House in US History. There is no legal precedent for those who serve the people to be held to NDA’s by the President…Trump’s NDA’s have no legal merit. The rules that apply are passed by the congress and under the standard code for levels of classified information.

For example: Trump hiding his secret tapes or eating handwritten notes are not protected under his so called Mob NDA’s.

I’m sure Mitch McConnell and Paul Ryan will say nothing against this…leaving the country to rely on the media and the courts for oversight of crooked Trump. McConnell and Ryan took an oath of office to defend the Constitution…they should resign for dereliction of duty.

Yeah… My guess is that at least anyone that is an employee or contractor within the Trump government probably had to sign a NDA. This could be the reason why Presidential appointees that are testifying before congress all seem to be reluctant to share any conversations that they had with the president… They all give the excuse that they are not at liberty to repeat any ‘confidential’ conversations but they decline to actually go so far as to claim any kind of executive privilege. The irony (or perhaps it is by design) is that if the congress had actually issued a subpoena, even if it was pro-forma, then the testimony before congress would have been classified as ‘compelled’ and the NDA would have been moot.

But the bigger issue is… how deep does this problem go? Do judicial nominees have to sign a NDA before they agree to be interviewed by the administration? What about SCOTUS nominees?

And as I understand it, all NDAs are prohibited for government employees for just that reason. “Such a broad agreement is unenforceable because the First Amendment protects federal employees’ right to speak in a private capacity about matters of public concern — and certainly the functioning of a presidential administration raises many issues that are of public concern.” (Esha Bhandari, Staff Attorney, ACLU Speech, Privacy, and Technology Project)

Why, it sounds like they require a document, what’s the name, when your allegiance goes to some person or corporation. Anyway, I am sure that I will remember in a bit.

Now, I do remember the day when people swore allegiance to the constitution and flag, and that defined what you could and did say.
