Discussion: Convicted Sheriff Joe Arpaio Has ‘No Idea’ If Trump Will Pardon Him

Doesn’t acceptance of a pardon require (for all practical purposes) an admission of guilt/culpability?

It would be a nice silver lining to watch this piece of hogshit choke on those words.

Convicted Sheriff Joe Arpaio Has ‘No Idea’ If Trump Will Pardon Him

Don’t you worry Joe, Trump is going to pardon you. An if there is any controversy in the media, he will brag about the call he got from Amnesty International telling him that he was the most forgiving president ever.

Does Fearless Leader know that Arpaio is not a billionaire?

We know one thing: He won’t apply for a pardon. Formal application requires that the person applying admit guilt.

Thus according to Burdick v. United States, 236 U.S. 79 (1915).

However, this is case law, determined by the Supreme Court, and Trump could have it overturned any time he wants.

By accepting Ford’s pardon, Nixon tacitly admitted guilt.

Is the subject loved by authoritarians and racists? Check.

Do people with brains say he shouldn’t make the pardon? Check.

I don’t think any more boxes need checking. He’s doing this.

The pardon privileges Presidents possess presupposes the person possesses fundamental decency and honor. Just another issue that Trump has forced us to think about amending.

Well, actually, by resigning Nixon tacitly admitted guilt.

Arpaio will simply believe he’s been relieved of an unfair, partisan, and unlawful conviction. He truly does believe he is not a crook.

(I sure would love to see him wearing pink undies in his own jail, though.)

It’d take a pretty coldhearted judge to put Arpaio in a general prison population. He’ll end up costing the taxpayers more than the other prisoners. Unless he goes with the “too old and sick to jail” used by mobsters.

Yeah, I know…

But they could still make him wear pink, no matter where they would put him. I would dearly love to see him get some of his own medicine (childish, I admit, but a girl can dream, can’t she?).

It’s not like Arpaio drove around with a broken tail light or failed to signal a lane change. That merits summary execution.

“Well, when the president does it, that means it is not illegal.”

He doesn’t even have to pardon him. Just tell the crowd he will, they will go crazy, then don’t follow through with it. They’ll never know the difference, and he won’t get any back lash. He lies about everything else, so why not lie about pardoning him?

This article is incorrect. A presidential pardon does not erase a criminal conviction.

Does a presidential pardon expunge or erase the conviction for which the pardon was granted?

No. A presidential pardon does not erase or expunge the records of a conviction. When a pardon is granted, however, OPA notifies the United States Probation Office and other officials in the district of conviction of the President’s action. In addition, OPA notifies the Federal Bureau of Investigation so that the pardoned individual’s criminal history record may be to reflect the grant of pardon. Thereafter, the criminal history record will list both the conviction and the pardon. Accordingly, a presidential pardon does not relieve the recipient from the obligation of disclosing his conviction in any circumstance where he is required to report that information. However, the pardoned person may include the information that a pardon has been granted and may present the warrant of pardon he has received as evidence of the pardon.

‘No Idea’

It’s so he’ll retain that happily surprised ‘I’m not the first runner-up, I’m Miss America’ face for the cameras…
