First the district court has to rule on the request for TRO, and if English wins, the government will appeal to the DC Circuit, and ask for a stay of the TRO. If it isnât granted, the government will probably seek a stay from the Supreme Court. The request for a stay goes first to the Circuit Justice assigned to the DC Circuit â Justice Roberts. If itâs denied, the request can go to the full Court. While Roberts is conservative, heâs also an institutionalist, and the Feebleminded Fraudsterâs present shenanigans donât strike me as something that would appeal to him. But weâll see, as Iâm sure it will play out rather quickly.
