So when does Congress go out of session again? Perfect time for executive appointments of all those waiting nominees and Congress won’t have any recourse, because no Supreme Court to appeal to.

The longest vacancy in history was 125 days. The last Democratic President that nominated a SCOTUS Justice with a Republican controlled Senate was Grover Cleveland. To refuse to confirm would be political suicide for the Republican party in a major election year.
So…whenever a president starts a second term, he or she is now forbidden from making any further judicial nominations. That’s where this logic takes us.
Ha! What a surprise. Judiciary Committee member and famous Canadian Ted Cruz will have plenty of opportunity to grandstand Mr. Obama’s appointment before the election…

- The Senate stonewalls, thereby giving Obama the platform to urge voters to go out in November to help the Democrats finish the job.
McConnell is going to succeed in this as well as he did in guaranteeing that Obama was a one-term President.

Should a Democrat be elected to the presidency while the GOP retains control of the Senate, what’s to prevent them from stalling approval of a replacement Justice for another 4 years beyond the current year?
