A great explainer on why the stakes in the forthcoming nomination fight and the 2016 election are sky-high. Those of us old enough to remember how Democrats’ infighting cost us multiple elections and consequently lost SCOTUS to the right wing for a generation are determined not to snatch defeat from the jaws of victory.

Nice summary. Didn’t see it written here (but that could be due to lack of sufficient caffeine), but the 4-4 split, making no precedent, could require the petitioner’s to refile the case, which could delay for 2 years or more a binding decision.

Why he let Scalia damage so much for so many years only to take him now, one can only be grateful for the damage left undone.

Republicans are panicking.
I’m watching the status quo/establishment Republicans panicking as much as the drama queen ones…it’s not about abortion.
I think that they are much more concerned about continuing and expanding their power and financial gains (Citizens United, and no regulations on oil, gas, coal,etc…, decimating workers’ rights, decimating voters’ rights) than they are about abortion. Abortion is something they use to turn out their voters and a bone to throw to them. Same w/ guns.
They want to keep the status quo and shore it up and they will try to distract everyone w/ the guns/abortion rhetoric. But it’s about money and power.

What they don’t seem to understand is that they probably went too far…and exposed their game. I wouldn’t put anything past them, to hold onto their power but right now I am having a schadenfreude milkshake for breakfast.

Heres the deal: any right-wing 4-4 decision made by the “Roberts Court,” as Democrats should learn to call it, should be loudly dismissed by all Democrats as a “lame duck” decision. The chorus should double in volume for any 4-3 decision. We could call it the Reid rule.

A conservative replacement, who doesn’t practically call the plays like an offensive coordinator, would be a huge improvement! The next Justice simply cannot and must not be sending partisan smoke signals, who to sue when and where for the best chance of achieving which result. Calling Scalia conservative is missing the point! I leave it to professional SCOTUS historians to find a more outrageously flagrant judicial activist.

Excellent article. It leads me suggest this:

Any 5-4 rightwing ideological decision that relies on the posthumous vote of Justice Scalia should be rejected and loudly dismissed by all on the grounds that it is “undemocratic” and should be reheard by the full court once the vacancy has been filled.

Anyone else feel like the entire Primary election equation just changed?

I may be alone here, but on the Democratic side, previously I was ok if Bernie or Clinton won. Now I’m actively against a Bernie win. I’m not willing to gamble the White House and SCOTUS on a ‘revolution’ that may not bear fruit.
