Trump will simply tell the IRS not to comply, and Democrats will have to be willing to push the point to its logical conclusion; the President will be in direct contradiction to Federal law that he swore an oath to uphold, and will have to be impeached. None of this should surprise anyone, since Trump’s history as a businessman shows that he flaunts his disavowal of his own word and dares anyone to take him on when he breaks his contracts. He’s a bully and a thug in the truest sense of the word, and Congress will have no choice but to observe THEIR Constitutional duties and impeach him for his refusal to obey the law.

Then it will be up to Republicans to show whether they really believe that the Constitution applies to them or not.

Trump will put Congress is in a position to enforce the law. On this one, I believe Congress doesn’t actually need to go to court. I think they can just hold Treasury in contempt and have Mnuchin or the IRS Commissioner arrested. I think this is because the law gives Neal the presumptive right here. There is actually nothing for the courts to decide. If Neal were to give them 24 hours to hand it over after the next deadline is missed and state that he will send the police (Marshalls?) to arrest Mnuchin, then Treasury might file something in court to seek a stay until the matter could be heard before court. I don’t know why a court would stop it though. I think the smart political move here is to tell Mnuchin that Neal will ‘lock him up’ if he doesn’t hand it over. Play that brinksmanship game and see if they blink. When they don’t, arrest him and let the GOP know you’re serious that laws will be enforced.

Here’s your problem, Sarah. There’s no qualifier in the law that says Congress has to pass a CPA exam or even say why they want to see the returns so that the IRS commissioner can evaluate whether to turn them over. “[S]hall furnish.”
