Discussion: 'Conflicts Prevent' Two Prospective Lawyers From Joining Trump's Team

Conflicts of interest ?
Imagination and reality
Truth and lies
Gets confusing when entering into a contract with trump, doesn’t it?

On second thought, maybe it was Victoria who scared the hell out of Trump!

First thing I thought when I saw the photo with this article is how Toensing and DiGenova look like the defendants in a murder trial.

“‘Conflicts Prevent’ Two Prospective Lawyers From Joining Trump’s Team.”

Translation: They saw the evidence and bailed. Bigly.

Probably; Trump has also been going after lawyers specializing in PR, not criminal cases. He knows he’s guilty, he’s just trying to find a way to spin things

Judge Jeanine Pirro must surely know some lawyers ? They tend to hang out near judges, I think ?

Conflicts obviously are not the reason but why make such a silly claim? Conflicts in the way it’s being used here means an intersect of both side of a case. I don’t think Ms. Toensing’s work with Clovis is a conflict so that can’t be it. The excuse implies the pair have some involvement or at least a tentacle in the other side of that case…with Russia or someone on the Russian side of it perhaps a cooperating witness.

Doesn’t matter if they charge him or not. The Grifter in Chief has a history of not paying his bills.

Trump just wanted Dowd gone. Floating diGenova as the replacement was just a vehicle to get Dowd to step down. diGenova and his wife, knew from day one they could not represent Trump because of those folks they were already representing.

Looks like they had already assumed that Trump was going to be indicted by Mueller and decided it would be much more profitable to represent those that are ratting Donald out. It’s always better to go with the winning side, not risk the humiliation of being fired or getting shorted your fees.

The conflicts that I have heard about so far come from Toensing’s actual and ongoing representation of Clovis and Corallo, and from the fact that she and her husband are partners in their law practices.
There is a Second Circuit opinion the title of which is United States v Curcio. You can look it up on Google Scholar. It gives the lay of the land on Conflicts of Interest in criminal cases. Typically the prosecution brings the motion to disqualify an attorney and the judge decides whether the client(s) affected can waive the conflict, or whether the attorney has to be kept from representing the new client. There is also a very illustrative (if long) opinion in the Eastern District case where the lawyers who represented John Gotti were disqualified from also representing Salvatore Gravano. The conflicts are not from playing on both sides of the case, but from having to zealously represent and maintain confidentiality of privileged confidential communications from individual defendants whose interests (in a criminal case) conflict. It also has to do with whether privileged information from one client will potentially influence or create ethical problems for the attorney in the other (conflicting client’s) representation.

Good point (I hadn’t thought of that.)

I was just about to make the same point when your comment appeared on the screen. But I also question how they could assist Trump on “other legal matters” without creating an additional conflict. I don’t think Sekulow - or anyone on Trump’s “team” - understands what a conflict is.

How long would it have taken to hear their names floated as being the next fired?

Sure they do, but they just don’t care when it’s to their advantage.

It’s like saying Trump makes mistakes because he has no political background. If he’s devious enough to work with Putin, he knows how to work Washington, too.

They weren’t physically attractive enough for the cameras.

Preshitident Manslut-Peehooker wanted to fight fire with fire, have a wolf guard the henhouse and did not want to bring a knife to a firefight.

DiGenova and Toensing did not have a broom to bring for the WITCH HUNT.

Two of the most despicable characters going. It would’ve been fun to see Mueller and company slap these two around in the legal arena. Now, they’ll just help the King on “legal issues”, i.e., going on Fox News and every right wing outlet to foster the lame conspiracy theory that will play well with the 35%.
