It sure ought to be.
I suspect the judge may be a conservative person and has tried to follow trump’s dictum to destroy anything Obama related. But I don’t know that for sure.

A sign of how thoroughly corrupt and insular the Washington press establishment continues to be is the fact that anyone regards Susan Collins, who manages to be both mealy-mouthed and deeply duplicitous, as an expert whose opinion is worth the time it takes to pin a microphone to her lapel.

She’s a liar: she’s a tool of the McConnell machine: she serves the dark money interests at the expense of her own constituents, the suffering citizens of Maine. She betrayed the Affordable Care Act when instructed to do so by Mitch McConnell, and rationalized the betrayal with some vague blather that any decent journalist could have blown up with three or four pointed questions (only luckily for the Republicans, reporters have a kind of gentlemen’s agreement never to ask them those kinds of questions), exposing herself for the really scummy politician she has always been.

Yet the Beltway press respectfully solicits her opinion, on the topic of a piece of legislation that would have been in a considerably stronger position if she had not followed orders, and poisoned it for Mitch.

I don’t like to begin my Sunday mornings with a volley of curses, but that’s what this article makes me feel like doing. Collins voted to kill the mandate when she went along with the GOP’s deficit-busting giveaway to their corporate overlords. She is utterly despicable.

Collins is absolutely right, there is “No reason” that “all of the good provisions” of Obamacare can’t exist without the individual mandate. In the olden days we had health insurance that was generally unaffordable without “all of the good provisions” in the ACA. Take away the insurance companies’ ability to filter out people who might get sick or to deny or cancel coverage if they actually do and you have created a problem that is much worse than the one you ostensibly solved. Logic, cause and effect, not GOP strong points.

Collins voted to confirm Roberts, Alito, Gorsuch and Kavanaugh. If the Texas decision is overturned it won’t be because the Court she helped shape supports the idea of universal health care.

On August 21, 2016, O’Connor issued a ruling against the Obama administration dealing with the government’s interpretation of Title IX rules. The guidance from the White House was issued in May 2016, and addresses the Title IX requirement that schools receiving federal funding not discriminate against students on the basis of sex. The ruling required that transgender students be allowed to use the bathroom that corresponds to their gender identity. O’Connor ruled that the new guidelines did not receive proper notice and comment prior to publication, and that Title IX and its implementing regulation are “not ambiguous” as to the “plain meaning of the term sex as used”. As such, he issued a nationwide injunction preventing them from being enforced with respect to students’ access to “intimate facilities.”[3]

On December 31, 2016, in a separate case, O’Connor issued a preliminary injunction against enforcement of the Obama administration’s regulations implementing Section 1557 of the Affordable Care Act (prohibiting sex discrimination in federally funded health programs) as a likely violation of the Religious Freedom Restoration Act and what he said was an improper inclusion of gender identity discrimination.[4]

On October 5, 2018, O’Connor ruled that the Indian Child Welfare Act was unconstitutional.[5]

On December 14, 2018, O’Connor ruled that the Affordable Care Act was unconstitutional.[6][7] O’Connor ruled that the individual mandate was unconstitutional by saying “[the] Individual Mandate can no longer be fairly read as an exercise of Congress’s Tax Power and is still impermissible under the Interstate Commerce Clause—meaning the Individual Mandate is unconstitutional.”[6][8] This is in reference to National Federation of Independent Business v. Sebelius which ruled that the individual mandate was constitutional because of the tax penalty. The penalty was removed by Congress in 2017. The ruling was deemed likely to be appealed.[6] According to Nicholas Bagley, law professor at the University of Michigan, the Affordable Care Act would likely remain in effect throughout the appeals process.[6] President Donald Trump commended the ruling on Twitter.[9][10][11]

And of course anyone that knows how these things works knows that you need a very large risk pool to cover people with pre-existing conditions without raising their rates or excluding them from coverage. That is what the individual mandate is about.

PLUS younger people or people with low incomes can get hit by a bus or get a long term chronic illness like cancer, leukemia, asthma… without warning.

ALSO of COURSE its’ going to hit people with incomes of $50,000 or less the most. Most of the people with higher incomes are going to be covered by their employer.

These things are VERY basic policy issues. She wants all the ‘goodies’ of ObamaCare without having it pay for and sustain itself. It doesn’t work that way.

She’s the new John McCain. She’s invited on the Sunday shows when the media needs to pretend they’re bagging a “moderate” in response to any issues that run afoul of her party. Her words are meaningless because she’s really just another water carrier for the the ultimate corruption in the Senate led by Mitch McConnell, and often in coordination with the White House.

I have the same reaction to her constant bullshit as you do. GAH.

And also…SHUT UP, SHUT UP, SHUT UP, COLLINS!!! Can’t wait until she gets turfed out of office in 2020 to someone that really knows how to stand up for women’s rights. She’s been getting away with that canard for way too long.
