It’s not clear at all from the story, but there are two subplots going on here.

The actual case is Cohen’s challenge to the document seizure, brought in federal court in New York.

Stormy Daniels (represented by Avenatti, a member of the California bar) has moved to intervene in the case. That would give her the right to participate as a party, on the ground that she has interests in the subject matter of the dispute that aren’t adequately represented by the government.

And since Avenatti isn’t licensed in New York, he needs to apply separately for permission to represent her on that motion.

The front-burner issue at the moment is not whether Stormy may intervene … it’s whether Avenatti will get permission to represent her on that motion.

It is very possible that Judge Wood will grant his application to represent her and then deny the motion to intervene when that comes before her later. (The government hasn’t taken a position yet… presumably that will be important to the judge.) But everyone gets to dirty each other up some more in the meantime.

Cohen’s legal team argued in a court filing Friday that Avenatti should be barred from the court hearing due to the “inaccurate statements”

If that were the standard then Trump and his minions would be without representation.

He used it repeatedly on Friday, including on MConnell’s show;.

How can Avenatti smear Mr. Cohen with what his lawyers admit is “factually accurate information”? If its true and accurate, then it seems reasonable to conclude that Mr. Cohen can only smear himself based on his own corruptible actions.

I am assuming the inaccuracies Team Cohen is talking about are the minor inaccuracies in the SAR information he released. I am not familiar with the argument that a lawyer has to be 100% accurate in everything he does to represent a client

Edit: I read the motion and the headline has very little to do with the reasons Cohen is seeking the court not rule favorably on Avenatti’s motion to appear pro hac vice on behalf of Stormy in the coming hearing. Mostly Cohen argues that Avenatti has proven to be such an effective TV lawyer he will probably make a mockery of the solemn court proceedings. He does suggest that Avenatti seems to have disclosed an illegally obtained SAR. Of course they don’t indicate how the information came to his attention beyond citing the Ronan Farrow story.

I suspect the court will grant the underlying motion and allow Avenatti to appear but will tell him not to stick his tongue out at Cohen

It also seems reasonable to assume that he probably smeared himself with his own shit when he was a baby.

avenatti is like a lava flow heading toward cohen and trump and maybe rudy. their wall-building efforts will not work. avennatti will flow over them. then mueller will flatten them with a steam roller. spontaneous combustion will start to sound like the happy alternative.
