Looking for Stormy Daniels material may not be the main purpose of the Mueller raid, but it’ll be a huge consolation prize to find the hard copy of Trump approving the $130K payment. Mueller is probably looking for much bigger crimes, but how great it will be to see Drumpf’s signature at the bottom of a document approving of the entire sordid mess with Stormy.
Can a lawyer explain whether the no-damage argument has any validity at all? It seems both perverse and the kind of thing that would have to be decided at trial, but IANAL.
TPM keeps identifying Cohen as “Trump’s personal attorney.” Is that in fact the case? In most media reports, Cohen is usually called a “special counsel” for the Trump Org. and most of his “legal work” – if you can call it that – appears to be bullying/threatening people who piss off Trump (and obviously making, ahem, problems like Stormy Daniels go away). AFAIK, Jay Sekulow is the president’s personal attorney. Cohen just worked for the company, and it’s not clear that he did any bona fide legal work at that. As Josh has reported here, his main "job consisted of being a fixer that connected the Trump Org to shady eastern European “investors” in Trump properties.
A pending criminal prosecution does not give you a pass from civil litigation. It might implicate your Fifth Amendment privilege against self incrimination to answer questions at a civil deposition or at trial. But Cohen has to continue. And if he is in jail, lots of times civil suits go forward via inquest or with an incarcerated defendant defaulting.
