Discussion: Chicago To Sue Trump Administration Over DOJ Sanctuary Cities Crackdown

“In 2016, more Chicagoans were murdered than in New York City and Los Angeles combined. So it’s especially tragic that the mayor is less concerned with that staggering figure than he is spending time and taxpayer money protecting criminal aliens and putting Chicago’s law enforcement at greater risk,”

What’s “especially tragic” is that whoever wrote this is well aware that the very large majority of those murders were committed by native-born American citizens, but they can’t let that get in the way of their agenda.

Chicago’s got lots of problems with its police force. If the DOJ had any sense, it would keep the CPD at arm’s distance.

Also, the DOJ hasn’t provided any proof that the city’s gruesome murder rate is tied to the undocumented. But facts aren’t the GOP’s strong suit, as we know.

Yay to the cities that are finding ways to challenge the feds on this.

Like so much of the Trump agenda they are critical of an opponent and criticize the opponent for actions team Trump are actually taking. In this case critical of law enforcement spending by the Chicago PD when they are the ones threatening the reduction of funding to Chicago. In addition they want to spend federal dollars on a useless wall.

I would think that this has already been decided. President doesn’t have the power to impound funds allocated by Congress.

Oh dear. This is probably precisely what Trump was hoping for. Chicago, of all places!

While this is true, I am doubtful that this is the situation here. Nixon did so much withholding (impounding) of appropriated funds that Congress passed The Congressional Budget and Impoundment Control Act of 1974.

The law was designed to prevent Nixon from doing exactly what he did, hence the court decision wasn’t even close.

I would expect that the present situation is different. I haven’t checked the approriation to be sure, but while Congress has doubtless appropriated the funds for these grants, the allotment of these grants has probably been left up to the DOJ. Congress doesn’t usually micromanage grants like this down to the local level.

The principle involved here is that the federal government can’t compel state and local law enforcement to enforce federal law. Furthermore, states can’t be coerced into accepting federal programs by the threat of withholding federal funds. This is why the Supreme Court ruled that the federal government could not impose the Medicaid expansion of the ACA on the states by threatening to withhold Medicaid funding, thus making the Medicaid expansion optional for the states.

I’m sure the thrust of the suit will be that the federal government cannot compel local law enforcement to enforce federal law against their will by threatening to withhold funds.

Yeah, I wasn’t sure on that, but though it might be used. One thing I noticed in that ruling was that Congress didn’t give Nixon the power to withhold. Wondering what the legislation on DOJ funds state (and too lazy this morning to look it up).

I grew up in Chicago and the rule in my family was that if you were in trouble, ask for help from anyone in the street --except the police. The CPD, whose every commissioner beamed from photographs with Al Capone’s arms around them while he was alive. The CPD found to have had a special building for torturing suspects. The CPD that has always policed the city by NOT policing designated areas and letting crime fester there. Phooey on them.
