If we punish those that go against the will of the majority of the people in this country, guess which party would disappear.

What is it about far right conservatives that makes them unable to understand the basic concept that the States cannot simply create legislation that violates an individual’s constitutional rights under the U.S. Constitution? I mean he just cited the Constitution five seconds before he makes this claim!

Funny, I thought the Judicial Branch was to uphold the law even if it defies the will of the people. If not, Dr Carson might be off picking cotton somewhere.

Mr. Carson doesn’t seem to understand that thingy about three co-equal branches of government. LOL. I understand he would like to use the Old Testament as the basis for our laws but that’s not how are government was set up and not how it works. Sad, pathetic, pandering.

I’m guessing he doesn’t think any of it’s at all ‘radical’, or that he positively believes it’s correct regardless, or, most likely, some of each.

This is someone fortunate to have on the one hand a civilized demeanor, a diligent yet compliant enough nature to allow him to absorb a large amount of received industrial orthodoxy exceptional dexterity and enough curiosity to be a top mechanic. He could have been an automotive or jet engineer, but became a neurosurgeon; the intellectual demands are comparable.

And he was so successful at his work, so positively reinforced in his ways and in seeing those ways rewarded, that he came to believe in his instincts on things he hasn’t got any feel for and never studied or thought about in any serious academic way, and as well in the causes and concepts promoted by folks who gave him those opportunities and praise and rewards.

He doesn’t understand, and, given who he hangs with, can not understand, that he’s completely full of shit.

He’s full of shit about everything he hasn’t been doing professionally, and the folks feeding him ideas and ideology are also full of shit, or are professional oligarchs acting in their own selfish interests, or serve ideologs and oligarchs.

In the result, an entire part of his brain that was never challenged, never stretched, never developed properly, now supports the nutty ideas he spouts and the others he repeats that, due to his faith in himself and in those who have praised and rewarded him, and treat him with the respect he somehow thinks everyone as smart and ‘good’ as him not just deserves but inevitably gets, he believes in.

This is the sort of person Sinclair Lewis had in mind when he wrote in Babbit, “When fascism comes to America, it will be wrapped in the flag and carrying a cross” …

… and in Carson’s case, with a stethoscope round his neck and carrying a black bag full of surgical instruments in his other hand.

The Dr. has a unique view of jurisprudence.

The function of the Congress is to create law.

The function of the Executive is to enforce the law.

The function of the Judiciary is to interpret the law.

I wonder.
I mean I wonder if political/religious fanaticism is a result of some specific under-developed intellectual capacity. I like the ‘intellectual virus’ theory, the ‘meme’ concept as put forward by Richard Dawkins. A virus can commandeer the genetic machinery of a cell to its own ends. It seems like fanaticism is virus-like in that it’s a bundle of entwined self-replicating ideas. A well educated person might be less vulnerable to attack, but minds all across the intellectual achievement spectrum can become infected and captive.
My favorite current example is Reza Aslan who did a splendid, brilliantly incisive job of dissecting the Jesus myth only to turn to Islam in his private life.

For all of their “Constitutional Conservative” talk, these people actually hate the Constitution. If you punish judges for finding certain laws unconstitutional, then the constitution ceases to have any power. All you would be left with are elected leaders demanding that laws be interpreted and executed in certain ways, regardless of any constitutional constraints. Judges, fearful of losing their jobs, would become obedient to Congress or the President, rather than a separate but equal branch of the government. In short, Dr. Carson is calling for another step toward fascism.

The US Constitution does NOT say that. It says, in Article lll that Judges have a “good behavior tenure” which means life long appoints are that unless a Judge commits High Crimes or Misdemeanors. The Constitution does NOT allow Congress to take a direct action on a Judge just because it’s current majority does not like the judgement. The Congress can amend legislation or amend the Constitution if it feels a Judicial interpretation of the original law was misguided but it CANNOT remove a Judge for reasons other that misconduct. The Judge has to break the law of violate ethics.

Listen folks. I know a shitload of very stupid surgeons and docs. I am in that biz. This guy, outside of his medical knowledge, is a very stupid man.

It’s not all that simple. Congress does have an oversight privileged. But it cannot do that willy nilly. What Carson is saying above is nonsense.

The more times I hear or read about Dr. Carson’s speeches, the more I think he simply does not fundamentally understand how our constitution establishes our government. This idea is simply idiotic on its face. If not for judges denying the will of the people, he would not be allowed into most schools, or other places of public accommodation. For him to make this statement exposes his profound ignorance on the judiciary’s role as an ENTIRELY SEPARATE BRANCH OF GOVERNMENT.

Congress can impeach a judge, just like it can impeach a president. Denying the will of the people is certainly not reason for removal from the bench.

Agreed. Just because he’s a brilliant surgeon, does not translate in to him being a brilliant individual outside of the operating room.

So Carson shouldn’t have a problem with a Democratic controlled Congress doing something about a judge who rules against gun restrictions that are supported by a majority of the public, right?

Who wants to ask the Speaker and Majority Leader how they feel about the doctor’s plan? To which party do they belong, again?
