In New York, it’s a felony to threaten someone with a phone. Or a hula hoop.
When did cops become such total weenies? They are afraid of their own shadows, ten year olds with toy guns and people aiming cell phones at them. LOL.
I have to say…that’s the most honest attempt at a made-up first name I’ve seen yet. None of this adding “Da” or “Ja” in front of a real name or making shit up out of thin air like “Plaxico” just to try to make it sound unique…no no…just make it literally “Unique.”
Arguably, this was assault (not battery), because there was no touching, just threatening. Granted, I’m not a criminal law nor a NY lawyer, but yeah, threatening people in a manner that actually makes them fearful of imminent bodily harm is usually a crime in my understanding.
Also too, the article indicates that it’s apparently it’s own crime of “menacing a police officer.” They throw in “disorderly conduct” all the time just to see what sticks. As far as “driving with a suspended license,” that just means that Unique is uniquely retarded, because who the fuck in their right mind plays that joke while they’re driving around without a license and actually expects that it wouldn’t result in them getting pulled over?
For it to be assault, someone has to be in reasonable fear for their safety. An officer is going to have to explain how someone pointing a cell phone at them created a reasonable expectation of fear. This is just one more case of the abusive policing. The only charge that may stick is the driving on a suspended license charge.

You assume it was recognizable as a cell phone at the time. I can totally see the officers not recognizing it as such simply because the hand position and gesture was so alarming that they ducked or whatever.
