But these are census documents - what would they have to do with the executive office at all? I realize that’s a dumb question because judges, but to me this seems way less probable than him winning on, say, the McGahn documents.

Put this under an impeachment inquiry and Dems win the executive privilege argument. Absent that, we’re counting on conservative courts to issue a key ruling that would limit executive privilege at a time when the SCOTUS expanded executive power in the travel ban case. They overrode actual federal law (Immigration and Nationality Act) to give deference to the executive orders of the POTUS notwithstanding all of his comments which showed that he was motivated by racial animus. Not saying that Dems can’t win that argument, but it’s more of a 50-50 thing and it could take a while.

I’m not sure the “threat” of executive priv has any legal standing. One doesn’t threaten to make docs subject to ep. Unless one is a mobster.

While I totally agree with the sentiment are you speaking from settled law? Or is there an area of reasonable interpretation? Is there precedent?

Executive Privilege to Trump means he can do what he wants despite what the law or the Constitution says.

Trump must be challenged by all means at the disposal of Congress.

Renato Mariotti (ex Fed prosecutor) just chimed in with this: "This is just a tactic that the Trump administration is using to aggressively position itself prior to a lawsuit filed by House Oversight. They did the same thing when House Judiciary subpoenaed the Mueller report and underlying materials but recently reached a deal with them.

Congress must litigate these faux Executive Privilege claims. The fact that Barr publicly used the threat of invocation as a bargaining chip proves it’s a false claim. If the courts won’t beat down the Administration*, Congress will have no investigative or oversight abilities. Executive Privilege is not an absolute privilege and cannot be invoked to hide crimes. Ask Dick Nixon.

I’m weary of the “but it will take too long” excuses. Sometimes you have to go to court, This is one of those times. Matters can be expedited. This is about the future of Constitutional democracy. Dems cannot we wimps.
