Discussion: Booker Says He'll Release Private Kavanaugh Doc, Prompting Cornyn Rebuke

We have a GOP congress that supports a President who lies and runs a criminal enterprise out of the Whitehouse. Why wouldn’t they also support and protect a fucking liar who was a candidate for the SCOTUS. Everything and everybody these people support should be held suspect until proven otherwise.

There is no actual downside here. Republicans have destroyed every single norm related to this process that there is no moral high ground for them to stake their claim on. Removal from the Senate requires a 2/3 majority. There aren’t enough republicans to oust him.

The only downside is that the rest of the documents are still not available and the WH will use this as a reason to withhold them. The only legal rational is a stretched reading of executive privilege. My personal take is that senators should attempt to sue for the release of these, even if he is confirmed. If they are denied standing, a Democratic House Oversight Committee could sue for access to the same documents and the House can make those documents public. There is no Trump Administration Privilege to Bush Era documents. It’s a farce and Democrats should expose it as one whether it stops this particular nominee or not.

They just took in roughly 1,000 new subscribers. That’s a lot of dough, of which a portion could fix this problem. One could say, where there’s a will, there’s a way.

Yes, but the documents they release now could suggest trails in the remaining ones. Imagine—they filtered out 90%+ and still couldn’t hide the stench of altar-right boy. The rest must contain true horrors.

This withholding of documents is a farce. Wish one of the Dems would simply ask Kavanaugh what he would do, and what he would conclude, as a judge, if a party in a case before him repeatedly claimed no knowledge of an issue in the case, but refused to release thousands of documents that would address their knowledge of the issue.

In every court and case I’ve ever been in, the party would be sanctioned, their case would likely be dismissed (if the plaintiff), or at a minimum, their credibility would be destroyed, and the trier of fact would be permitted (and the jury would be instructed) to take a negative inference that the documents would show the opposite of what the party claimed.

Concur. Feinstein released materials and all she got from the old white guys were a few harrumphs.
