For a nominee to the position of AG, Barr is ignorant of what I consider basics in the Constitution. He doesnât know whatâs in the emoluments clause, and heâs not familiar with birthright citizenship. Hey, Trump! Pick me!
Wow, just wow. I thought legal precedent is what guide legal thought? How can one toss out the language in the 14th Amendment? How may cases have been built upon the words written 150 years ago?
The amendment does, in fact, say that âAll persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United StatesâŚâ
âIt says right there in the 14th Amendment,â Hirono protested, asking if Barr would like to do away with the legal right ensured by the amendment.

Listening to Barr avoid these questions is like listening to a guy about to perform surgery on you saying that âhe hasnât really familiarized himself with the circulatory systemâ or that âI would need to take a closer look at the relationship between the nervous system and bodily functionsâŚIâm not sureâŚâ
Can you imagine the head explosions if a Dem AG nominee told a Republican senator that he âhadnât really looked atâ if the Second Amendment has any bearing on firearms ownership?
The thing is, Barr is a highly experienced lawyer who served previously as AG. He knows perfectly well what the precedents on these issues are and why heâs being asked about them. Barrâs vapid response, as well Trumpâs bigoted assertion, presses the question, âWho is an American citizen?â The question could be asked again in 100 years should this purist citizen fantasy take hold. To extrapolate the lines of purist reasoning would lead to the conclusion that we will be a nation with a declining citizen population.
More than being a gobsmackingly uninformed response to Hironoâs question, it brings me to question how seriously he takes the 14th Amendment as a second bill of rights.
