For a nominee to the position of AG, Barr is ignorant of what I consider basics in the Constitution. He doesn’t know what’s in the emoluments clause, and he’s not familiar with birthright citizenship. Hey, Trump! Pick me!

Wow, just wow. I thought legal precedent is what guide legal thought? How can one toss out the language in the 14th Amendment? How may cases have been built upon the words written 150 years ago?

The amendment does, in fact, say that “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States…”

“It says right there in the 14th Amendment,” Hirono protested, asking if Barr would like to do away with the legal right ensured by the amendment.

“I haven’t looked at that issue legally, that’s the kind of issue I would ask [the Office of Legal Counsel] to advise me on, as to whether it’s something that’s appropriate for legislation, I don’t even know the answer to that,” Barr replied.

Riddle me this then Master Barrister…what do you know of the difference between an amendment to the constitution and a piece of legislation?

You were Attorney General at some point in the past were you not? Perhaps you don’t know the answer to that either.

Listening to Barr avoid these questions is like listening to a guy about to perform surgery on you saying that “he hasn’t really familiarized himself with the circulatory system” or that “I would need to take a closer look at the relationship between the nervous system and bodily functions…I’m not sure…”

Can you imagine the head explosions if a Dem AG nominee told a Republican senator that he “hadn’t really looked at” if the Second Amendment has any bearing on firearms ownership?

The thing is, Barr is a highly experienced lawyer who served previously as AG. He knows perfectly well what the precedents on these issues are and why he’s being asked about them. He’s playing stupid on purpose and of course the GOP majority is happy to snigger and confirm him anyway. It’s fucking infuriating.

Barr’s vapid response, as well Trump’s bigoted assertion, presses the question, “Who is an American citizen?” The question could be asked again in 100 years should this purist citizen fantasy take hold. To extrapolate the lines of purist reasoning would lead to the conclusion that we will be a nation with a declining citizen population.

More than being a gobsmackingly uninformed response to Hirono’s question, it brings me to question how seriously he takes the 14th Amendment as a second bill of rights.
