A question: isn’t there somewhere in either the Inaugural Oath or in the Constitution that has the phrase “take care that the laws be faithfully executed”?

Doesn’t this qualify as more than subverting the intent of the law and move into betrayal of Constitutional Duties?

Although the major traction might be on Capitol Hill.The Democrats will be hammering this in their stop-the-sabotage efforts.
Bannon’s loyalty to Trump upgraded to 1000%.
It’s just that he shows it in his own way.

The TV ad I’d like to make here would be cutting back and forth between 5 second blocks of grateful people in doctors offices, hospitals etc. and a 2 second cut of Bannon ““Gonna blow that thing up,” he said. “Gonna blow those exchanges up, right?”” Ovah and Ovah.

No making these payments was actually subverting the Constitution as determined by a Federal Judge. The money being used to make these payments was never appropriated by Congress, therefore they are illegal payments.

Unless of course the millions in the individual market who will now be able to utilize the same rules as multi-state companies in obtain lower cost insurance plans like the change.

Sadly no. The issue with the CSR’s is one that the House republicans had already raised in Court, though the case hasn’t been decided by a Circuit or SCOTUS yet. It comes down to the wording in the ACA law itself, where they forgot to include that Congress had to appropriate the money for the CSRs, even though they stated quite clearly that the HHS does have to pay them to insurance companies. And the District Court that gave the House standing (in a very rare move) already sided with the GOP and said that Obama making the payments was unconstitutional.

So in this case, which actually is not surprising he is refusing to make the CSR payments, it can easily be played off as a different interpretation of the law, not out right refusing to up hold the law. Its absolutely an attack on the spirit of the law, and they hanging their hat on a technical detail that probably won’t be upheld in Circuit or SCOTUS, but its not an attack on the actual wording of the law.

Inevitably though, the insurance companies will almost assuredly sue HHS and demand the CSR payments…and that IS in the law too. And they will most likely win.

What this all comes down to is a poorly written law, but precedent exists to indicate that if the law says a Department WILL make payments, Congress is obligated to appropriate that money, even if the law didn’t actually spell out that Congress has to appropriate that money.

I gather from this that the effort will be to force things back to the Senate negotiations,leading to an eventual appropriation?

The insurance companies can sue all they want, they have no legal ground to stand on. These payments are illegal, as determined by both a Federal District Court Judge and the DOJ.

Since the House of Representatives is who sued to stop these payments, I would guess they are not going to appropriate the money for these payments.

That and he did it to undermine the legacy of the first black president, a man Trump refuses to believe was in every way better than he is despite the facts being crystal clear

Trump: Its important to note that I am doing this to keep my campaign promise. I am a man with large hands who keeps his word. Also, my supporters love it and The Black Guy is now being humiliated.

Mrs darr and I are a bit older, seniors you might say. I have Medicare, she does not, yet. Been buying her insurance on the open market, not thru the ACA. But even still the policy she has is going away. There are exceedingly limited options locally for her going forward and now even the limited options that were around will be going stratospheric because of trump’s EO. Luckily she is out of town or she would have gotten blistered ears listening to me over the past couple days.
This is now very personal between me and that fuckwad in the Oval Office.
