Eventually, you’d think, state attorneys general are going to realize that the Full Faith and Credit Clause of Article IV and the Equal Protection Clause of Amendment XIV taken together with the Supremacy Clause of Article VI will trump any state constitution.or statute, whether passed by popular referendum or not. Fundamental rights are not subject to the will of the majority. As Justice Robert H. Jackson once wrote, “fundamental rights may not be submitted to vote; they depend on the outcome of no elections.”

Well, one state AG did realize just that and refused to defend his state’s ban on gay marriage. He’s the 2nd best looking AG in the country…KY AG and gubernatorial candidate Jack Conway.

Actually, I rather like the idea that they’re pushing to defend this even when they know it’ll lose. Make it lose. Establish the precedent.
Next comes the Arkansas state legislators writing op-ed pieces on how the courts are ignoring the will of the people.

Man, I love this because it’s simply fair and also because it’s one in the eye for people who think their particular faith or their interpretation of it should dictate the laws of this country. The Constitution explicitly says otherwise. If you don’t like gay marriage, don’t get gay-married, simple as that. And keep your faith out of the schools, out of the public meetings, and off the courthouse lawn, OK? It’s the law, end of story.
