IANAL, but my impression is that this appeal is about whether a court should be allowed to get to the factual issues. Which would mean depositions, testimony, perjury, witness tampering and all that good stuff.

Maybe I’m missing something (IANAL) but it sounds like the governor just confessed with that statement. He has no business interfering with a charter school’s decision of whether or not to hire someone. This sounds like a slam dunk to me in an abuse of power case.
