I've read this article a couple times and for the life of me can't find any details about the Mayor's driver being assaulted.

Now I’m REALLY confused. The DRIVER filed criminal trespassing charges against a reporter for coming on property that the MAYOR owned? That the driver had nothing to do with other than acting as the Mayor’s driver and/or hired thug? HUH? What am I missing?

If I was the reporter, I would return to the house “seeking a comment” with an armed security guard and a camera running. As far as I can tell, the driver is not authorized to issue a trespass warning.

It’s just typical poor headline writing. The driver assaulted and threatened the reporter. But yes, it reads like the driver was assaulted, and then the driver threatened the reporter.

Alabama is a stand your ground state. If the reporter parked on a portion of the driveway that is part of the mayor’s property and didn’t leave when asked, the driver may well have a valid SYG defense.

I’m not agreeing with this, mind you, just pointing out the statute.

The driver isn’t the property owner. It’s not his ground to stand on. In any case, there was no imminent threat of violence from the reporter so there is no reasonable justification for a violent response.

I’m unsure how the word “reasonable” enters into a discussion about an event in Alabama.

Maybe the mayor can’t be found because he’s really Donald Trump. That would actually explain the entire scenario.

The statute states one can act to protect a third person. It’s not necessary to be the owner. And not leaving when asked has been held to be a valid SYG defense.
