I have a question on this. Assume that a fine is issued. The rep says “im not paying.” He then sues the speaker/house of representatives under the speech and debate clause, which immunizes members for “speech” on the house floor. If the recording of police conduct is “speech”, then is the use of a recorder on the floor also “speech?” And if so, why isn’t the member immune from prosecution?
