I’ve never been one to not be confused, but this puzzles me. Before this was signed, we had a Federal law used as a basis for Hobby Lobby by the Supreme Bigots, and laws in perhaps twenty states along these lines. Is there something in particular about this law that has differentiated it from all those?

I’m no lawyer and the details escape my poor attempts to research it, so just wondered if anyone knows in case some bigot tries to pull that Mike Pence bullshit line on me.

Watch Gov Pence’s interview on ABC Sunday morning…a link is featured on the TPM front page…and you’ll see for yourself that Pence can not explain what the law is or how it will affect people. Further, he refused six opportunities to state that discrimination will not be tolerated in Indiana.
The law is quite different from the federal law and laws in other states. It’s biggest problem is that it gives bigots the notion that somehow discrimination in the name of their religion will be tolerated…and, under this law it may or it may not depending a full range of variables. The law is a mess and should be repealed immediately.

The federal law, and other state laws don’t apply to businesses, just individuals. “No gays in my house.” is different from “No gays in my business.”. In practice, the federal and state laws have mostly been used by Native Americans and letting them use things like peyote or eagle bits and pieces, and protect various sacred sites from development. You cannot use them to discriminate against people the way the Indiana bill would allow.

The Indiana law allows corporations, businesses, partnerships and entities other than individuals to claim a religious exemption form following laws against discrimination.
There are no restrictions or guarantees of civil rights expressed or implied by the law.

Its sole purpose is to skirt the Civil Rights Act’s “public accommodations clause,” as well as the equal protection clause of the 14th Amendment.

Basically, it is a license to discriminate—exactly what it was intended to be by its authors at ALEC.

The federal Religious Freedom Restoration Act, and most of the other states RFRA laws, explicitly exclude for profit companies from claiming religious exemptions and pertains mostly to churches and non profits.

“Disgust” is a good word describing how one should feel about this law and those who supported and enacted it. I would also use the word “contempt”.

I think it would be appropriate to ask the Republicans that are interested in running for president their opinion of this law.

Also ask them if it’s OK to discriminate against GLBTs.
