Discussion: Affirmative Action May Return To Supreme Court For Final Judgment

Discussion for article #225144

“Rick Hasen, a law professor at University of California, Irvine predicted that if the case returns to the Supreme Court, it will rule 5-4 against the school’s affirmative action program.”

Duh! Of course they will. Racism is a thing of the past! Haven’t you heard?

Did a little digging: The Project on Fair Representation is (Surprise!) a 501©3 that was spawned from Project Liberty, Inc, which is (Surprise!) another 501©3 that looks like a dumping ground for money from the corporate sector. Their shining light is someone named Richard Cornuelle, a dead Libertarian who was not fond of social welfare in any way. The PFR has the following goals in mind:

Voting: Reforming those provisions of the Voting Rights Act and other laws that encourage and mandate the creation of racially gerrymandered voting districts.

Education: Ending the use of race-based affirmative action in college admissions and K-12 student assignments, as well as racial considerations in awarding scholarships, fellowships, and academic enrichment programs.

Contracting: Challenging in the courts municipal, state, and federal programs that award fixed percentages of contracts to individuals and firms based upon race, gender, and ethnicity.

Employment: Representing individuals who have been victims of racial discrimination in hiring, firing, and promotion.

Ain’t that sweet
and a (SURPRISE!)?

“The plaintiff, Abigail Noel Fischer,
says she was rejected by UT because she’s white
” “UT’s affirmative action program admits the top 10 percent of students in each high school graduating class.”

So she wasn’t rejected because she’s white, she was rejected because she wasn’t among the top 10% of her graduating class.

Apparently hard work is no match for a good lawyer

“
if it doesn’t tell us what its goal is, it is impossible for the University to prove that its use of race is necessary to achieve the goal
”

But the University didn’t create a scale. The goal was “diversity”, in which case any is better than none. The University has the right – freedom from repressive government – to find whatever level of diversity it wants to commit to. It’s no more unconstitutional for the University to pick an arbitrary number, than it is for the court to claim none is “better” in some arbitrary sense.

Unless, of course, one believes that government should determine what we can think.
UT’s affirmative action program admits the top 10 percent of students in each high school graduating class. Given the racial makeup of schools across Texas, the policy is known to enhance admission of African-Americans and Latinos.
So the university wants to choose students according to grade score and performance levels and actual race distribution of the Texas population instead of only rich, poor-performing, privileged white folks?

Yep, that’s Texass.

Just kill it, you racist fucks. You can’t help yourselves
and your Pyrrhic “victory” will pale (pun intended) in comparison to what happens to your decrepit, shitburnt political party.
