Did a little digging: The Project on Fair Representation is (Surprise!) a 501©3 that was spawned from Project Liberty, Inc, which is (Surprise!) another 501©3 that looks like a dumping ground for money from the corporate sector. Their shining light is someone named Richard Cornuelle, a dead Libertarian who was not fond of social welfare in any way. The PFR has the following goals in mind:
Voting: Reforming those provisions of the Voting Rights Act and other laws that encourage and mandate the creation of racially gerrymandered voting districts.
Education: Ending the use of race-based affirmative action in college admissions and K-12 student assignments, as well as racial considerations in awarding scholarships, fellowships, and academic enrichment programs.
Contracting: Challenging in the courts municipal, state, and federal programs that award fixed percentages of contracts to individuals and firms based upon race, gender, and ethnicity.
Employment: Representing individuals who have been victims of racial discrimination in hiring, firing, and promotion.
Ainât that sweet⊠and a (SURPRISE!)?

So she wasnât rejected because sheâs white, she was rejected because she wasnât among the top 10% of her graduating class.

Someone needs to illustrate that the attorney, is a well funded troll lawyer for many things âconservativeâ.

But the University didnât create a scale. The goal was âdiversityâ, in which case any is better than none. The University has the right â freedom from repressive government â to find whatever level of diversity it wants to commit to. Itâs no more unconstitutional for the University to pick an arbitrary number, than it is for the court to claim none is âbetterâ in some arbitrary sense.
Unless, of course, one believes that government should determine what we can think.
