Any charges should apply to the adults who allowed the child anywhere near a loaded rifle or were dumb enough to have an unsecured weapon near a child too young to know the difference between a toy and a real rifle.
Responsible gun owners secure their weapons when not in use. Transporting a loaded, unlocked weapon where a 5-year old can get to it was an invitation to trouble.
A 7-year old is dead from a gunshot and the police “don’t know” whether they will be pressing charges? Whoever owns that weapon is guilty of murder.
